Rule of Law / Access to Justice

What is Rule of Law / Access to Justice?

The Rule of Law is a fundamental constitutional principle where all individuals and institutions, including the government, are accountable to laws that are publicly promulgated, equally enforced, and independently adjudicated. Access to Justice is the ability of people to seek and obtain remedies for grievances through formal or informal institutions of justice, in conformity with human rights standards.

Historical Background

The concept of Rule of Law originated with ancient philosophers and was further developed by thinkers like A.V. Dicey. In India, it is a cornerstone of the Constitution, declared a Basic Structure doctrine by the Supreme Court in Kesavananda Bharati case (1973). Access to Justice has been emphasized through Article 39A (free legal aid) and various judicial pronouncements expanding the scope of Article 21.
